Professional Regulations

The following professional regulations apply:
– Federal Lawyers’ Act (BRAO)
– Rules of Professional Practice (BORA)
– Accredited Specialist Lawyers Ordinance (FAO)
– German Regulations on Lawyers’ Fees (RVG)
– Code of Conduct for European Lawyers (CCBE)

The professional regulations can be inspected and retrieved both in the German and the English language on the homepage of the Federal Chamber of Lawyers (www.brak.de) under the section “Berufsrecht”.

Based on professional regulations, lawyers are prohibited from representing conflicting interests (section 43a para. 4 Federal Lawyers’ Act (BRAO)). Therefore, a conflict check is always first performed before a mandate is taken on.

Out of Court Settlement of Disputes

In the case of any disputes between lawyers and their clients, it is upon application possible to settle the dispute out of court at the regional Chamber of Lawyers Munich (according to section 73 para. 2 no. 3 in conjunction with para. 5 BRAO) or at the Conciliation Committee of the Bar (section 191 et seq. BRAO) at the Federal Chamber of Lawyers, to be found on the Internet via the homepage of the Federal Chamber of Lawyers (www.brak.de), e-mail: schlichtungsstelle@brak.de
